Agreement to Terms
By accessing and using the services of Foam Adventuru ("Company", "we", "our", or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
Services Description
Foam Adventuru provides professional interior design services including but not limited to:
- Residential and commercial interior design
- Space planning and layout design
- Colour consultation and material selection
- Project management and implementation
- Design consultation services
Client Responsibilities
As our client, you agree to:
- Provide accurate and complete information about your project requirements
- Grant necessary access to the property for design and implementation
- Make timely decisions on design proposals and material selections
- Pay all fees and expenses as agreed in the contract
- Comply with all applicable building codes and regulations
- Obtain necessary permits and approvals for construction work
Payment Terms
Fees and Billing
- Design fees are based on project scope and complexity
- Initial consultation fees are due at the time of service
- Project deposits are required before work commencement
- Final payment is due upon project completion
- Late payment charges may apply for overdue accounts
Additional Costs
- Materials, furniture, and fixtures are billed separately
- Third-party contractor fees are client responsibility
- Travel expenses for projects outside Greater Manchester
- Storage costs for purchased items
Intellectual Property
All design concepts, drawings, and creative work remain the intellectual property of Foam Adventuru until full payment is received. Upon full payment:
- Clients receive usage rights for the specific project
- Foam Adventuru retains rights to showcase work in portfolios
- Design concepts cannot be reproduced for other projects without permission
- Third-party intellectual property rights are respected and protected
Project Changes and Cancellation
Changes to Project Scope
- Changes to agreed project scope may incur additional fees
- Change requests must be submitted in writing
- Timeline adjustments may be necessary for scope changes
Cancellation Policy
- Projects may be cancelled with 14 days written notice
- Cancellation fees apply based on work completed
- Client is responsible for costs incurred up to cancellation date
- Custom-ordered items may not be refundable
Limitation of Liability
Foam Adventuru's liability is limited to the total amount paid for services. We are not liable for:
- Indirect, incidental, or consequential damages
- Delays caused by factors beyond our control
- Issues arising from client-supplied materials or specifications
- Damage to existing property during renovation work
- Third-party contractor performance or workmanship
Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, government actions, war, terrorism, pandemics, or natural disasters.
Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through:
- Good faith negotiations between parties
- Mediation through a mutually agreed mediator
- Arbitration if mediation is unsuccessful
- Governing law: England and Wales
- Jurisdiction: Courts of England and Wales
Privacy and Confidentiality
We respect your privacy and maintain confidentiality of your personal information and project details. Please refer to our Privacy Policy for detailed information on data handling.
Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified terms.
